Bluegrass Jam at the Road Runner Cafe. A big "Thank You" to those who
have been bringing songs with lyrics and chords to share with us as it
eases the learning process for those of us who are beginners. Bring
friends who enjoy music, even if they only enjoy listening. Clapping
and stamping of feet is encouraged. The jam is not just for bluegrass,
if you have a blues, rock, folk, any other genre song--please feel

DISCUSSION: WINDOWS 7 INSTALLATION

a. I also had the trial Win 7 erroneously installed on my computer. I
had tried to buy the program to download but was unable to download
because it was to be purchased with a Canadian credit card but I
wanted it to be in Mexico. A supposed no-no. A computer literate
friend re installed the XP discs that I had brought with me. My
computer is now working correctly. Hope this helps. abch@telus.net

DISCUSSION: IRS TAX FORMS

a. This is what I know about the requirement to file these forms to
the IRS if you have a Fideicomiso or Mexican Trust when you own
property in Mexico. When this issue first came up last year I checked
with our CPA who then called the IRS. From what he said it is a
requirement that these forms be filed and should have been filed for
the prior three years.
The trouble is that he never could get a straight answer out of anyone
with the IRS. We went ahead and filed for the years of 06, 07, and
08. He wrote a cover letter saying it was understood that there
wouldn't be a penalty if the forms were filed first by the 15th of
September and then by the 15th of October. Because he sent a schedule
of expenses and showed no income the IRS thought this was rental
property down there and assigned us a tax ID number. He tried though
various phone calls to the IRS to let them know that this property was
a vacation home and had never generated any income. We started
getting lots of mail from the IRS stating our forms were incomplete so
I gave our CPA a power of attorney to deal with the matter. They were
suppose to get back to him last December but never did. In the
meantime he quit his practice and so we had to get another tax man.
He again checked with the IRS and this is a requirement but no one
working there seems to know too much about it. On the 12th we filed
the necessary forms and we are just waiting to hear from the IRS in
regard to this as I am sure we will. Our tax man said that the fine
was 10% of the value of the property but I am sure that if he called
someone else he would get a different answer. Cheryl, please post all

b.    Regarding questions about forms 3520 and
3520A, reporting fideicomisos (FC) to the IRS.The IRS has always
required that foreign bank/Investment accounts, corporations, and
trusts (FCs) be reported annually. There is a place to check off this
information on the IRS Form 1040 tax form. In the past, some IRS
agents have told inquirerers that if FCs generate no income they do
not have to be reported. Income or not, congress and the IRS
commissioner decided last year that informational returns must be
filed. We can hope they come to their senses and change their mind.
However, for those who had never reported their offshore FCs, bank
accounts or corporations, an amnesty period for reporting without
penalty was extended to October 15, 2009, Tax accountants/lawyers have
used scare tactics to drum up business at upwards of $300 for the
initial phone conversation, and up to a total of $1200 for filing the
two forms. The IRS will accept downloaded forms filled out to the best
ability of the FC holder. If you did not file before the amnesty
deadline, you might want to talk to an IRS agent, accountant/lawyer,
or take your chances as many property owners have done and not file.
This past summer, the US and Mexico signed a bank information exchange
agreement. From what I gather, the IRS now has information on all FCs
and their owners. Whether they pursue fines for previous non-filers
who did not file during the amnesty period only time will tell.
Hopefully they will not, but as in most cases, ignorance of the law
is usually not an acceptable defense. TS

c. Was looking for a diesel truck mechanic, preferably located in La Paz.
Had an issue with power going up ( arriba), feels like it has gotten worse .
changed the fuel filter , fuel pump was a thought but had the Ford
dealership leaning more towards fuel injection and perhaps the turbo.
Don't really like the protocol at the dealership and would like to
know what others had for options or with any similar issues with a '99
F-250, 7.3l diesel.

ANSWERS TO QUESTIONS

a. The PROFECO office in La Paz have staff that can help those that
do not speak Spanish.

b. Just wanted to respond to the 3/11 posting regarding my experience
with Mexicana flight charge. When I visited the Mexicana website to
make my reservation I got all the way through to the purchase area and
could not get the confirmation I was looking for. I tried it again
and the same thing happened. So I called the phone number on the
website and checked with a person. The phone representative could see
that there were two attempts on my Credit Card to purchase tickets
through Mexicana, but they were pending purchases. Together we
reviewed what I had entered for credit card information and sure
enough, I had transposed a number in the expiration date area. I
entered the information correctly and "Voila!" the reservation was
complete and there was only one charge my account, confirmed by the
person I had on the phone. I just returned from Mexico and my credit
card bill was here. There was only one charge on my account. Hope
